KUALA LUMPUR: The concept of child marriage appears to be alive and well in Malaysia based on government statistics of premarital HIV screening for Muslims preparing to get married.
Last year, 479 children under 15 years, two of them boys, were getting ready to tie the knot. And 32 of them were below 10 years. None of them were found to be HIV-positive.This is based on Health Ministry statistics of premarital HIV screening for Muslims, a compulsory requirement for those wanting to get married.
However, it is not certain if any of these applications for marriage were approved by the state religious department.
Under the Syariah Family Law system in Malaysia, prospective brides and grooms —irrespective of age — have to apply for permission from their respective state religious departments to marry. In the application form is a section for HIV premarital screening, which has to be filled by a medical doctor.The result of the test does not affect the granting of permission. What’s shocking is that the doctors had signed off the forms for the children without batting an eyelid.
Malaysia is not a country that encourages child marriages. But neither does it outlaw it outright. Under Malaysian law, a Muslim girl below the age of 16 can marry, provided she has the consent of the syariah court. The syariah court is supposed to rule on each and every case and cannot give blanket permission.And under the Law Reform (Marriage and Divorce) Act, which applies to non-Muslims, marriage is allowed only for people 18 years and above. However, a girl aged 16 years and above may marry, conditional upon a licence being obtained from the chief minister or menteri besar.This means that it is supposed to be very difficult for a Muslim girl under 16 to get married, and it is supposed to be impossible for a non-Muslim girl under 16 to get married at all.
However, according to the 2000 Census, there were 11,400 children below 15 years of age who were married — 6,800 girls and 4,600 boys. Of the 6,800 girls, only 2,450 were Malay. This means that the syariah court gave its consent to each of these 2,450 under-age girls to get married.The remainder of 4,350 girls were non-Malays comprising 1,550 other Bumiputera, 1,600 Chinese, 600 Indians, and 600 others. It is not known whether they hadgot their licence from the relevant minister, but even if they did, it would have been illegal, since there are no legal provisions for a non-Muslim under 16 years to get married.“We are deeply troubled by this issue and we are currently undertakingcomprehensive studies to provide a clearer picture of the incidence and frequency of child marriages across the board,” said Women, Family and CommunityDevelopment Minister Datuk Seri Shahrizat Abdul Jalil when contacted by the New Sunday Times. “A child does not have the choice or capacity to give his/her full consent,and as such child marriages must be viewed within the context of force and coercion; an act that subjects the child to physical, social and psychological trauma and abuse, ” Shahrizat said. “At present the Women, Family and Community Development Ministry is not empowered to intervene in these matters unless an offence has been committed under the Child Act 2001 or, as provided by that same act, for the purposes ofchild protection where abuse is suspected.” The registration of Muslim marriages comes under the purview of the state religious authorities, while the registration of non-Muslim marriages comes under the National Registration Department. The minister said the ministrywould be undertaking a study on child marriage in Malaysia, which would serve as the basis for future legislative change.The phenomenon of child marriages may seem isolated when only one or two cases get reported in the news, such as the two girls in Kelantan recently. They were aged 10 and 11 years, and were allegedly married off to 40 and 41-yearoldmen respectively. But these are the controversial cases that make it into the public sphere. As the statistics show, child marriages are not isolated cases.This trend will have a head-on collision with the law soon, when Malaysia removes all its reservations to the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW).
This is because Article 16(2) of the convention, which deals specificallywith child marriage states: “The betrothal and the marriage of a child shall have no legal effect, and all necessary action, including legislation, shall be taken to specify a minimum age for marriage and to make the registration of marriages in an official registry compulsory.”Women’s Aid Organisation executive-director Ivy Josiah said the current laws needed to be amended, because it did not make sense for syariah and the civil LRA to be inconsistent with the Child Act 2001.“There is a serious flaw in our laws. Both the Convention on the Rights of the Child and the Child Act define a child as a person below the age of 18.“It doesn’t make sense to allow children to get married. This goes against the grain of universal standards of human rights for children. These are not young marriages; they are child marriages.“The state has a duty to protect children, so it should get rid of these loopholes,” said Josiah. Lewis Waterman's invention of a practical fountain pen, patented in 1884, had solved the problem of portability. You no longer had to carry around an inkwell to be able to write when and where you wanted. But the ink still took a while to dry and was subject to running and smudging. American banker John L. Loud patented a ballpoint pen in 1888. It used a ball-and-socket to deliver sticky, quick-drying ink. Too sticky: The ink was so coarse, it didn't really work well on paper. (It was a good idea on paper, except literally.) It did find industrial uses for writing on leather and cloth.

MISTERI KELLIE CASTLE
Kali ini cuti Sabtu membawa kami ke destinasi Batu Gajah, Perak. Terlalu cepat masa berlalu, dari Gua Tempurung, kami menyusul ke Gopeng, akhirnya tibalah destinasi yang dituju, KELLIE CASTLE! 
Hujan lebat sejak dari Gopeng, seolah-olah tidak membenarkan kami menyelongkar misteri yang sering diperkatakan di dada akhbar, yang sering bermain diminda pendengar dan pembaca yang belum mengunjungi istana ini. Jelas terpancar sinar ingin tahu dengan penantian penuh bererti itu telah menambahkan semangat pengunjung setia yang masih terkandas. Cuaca masih samar-samar samada mengizinkan kami dan pengunjung lain memulakan tujuan kami. Tetapi semangat ingin tahu itu tidak menghalang dan membakar naluriku ingin tahu sejauh manakah MISTERI diwawarkan itu? Terlalu banyak cerita-cerita misteri dari blog2 pernah kubaca....inspirasi mereka telah membawa kami ke sini akhirnya! Dari jauh istana ini nampak menyeramkan."Cantiknya....Fuh...Green! Cool! Peace!..mataku terpukau melihat keindahan kehijauan Ladang Getah Kinta Kellas ini. Pada awal tahun 1890-an, pengusaha British juga telah membuka estet-estet getah di sekitar Batu Gajah. Antaranya ialah Ladang Kinta Kellas, Ladang Kinta Valley, Ladang Harewood, Ladang Sengat dan lain-lain. Antara pengusaha British yang paling terkenal di Batu Gajah ialah William Kellie Smith dan Alma Baker. Ladang ini berada ditengah rumput hijau dipimpin alunan air sungai yang bergerak perlahan seolah-olah memberitahu ketenangan, kesayupan dilihat pengunjung tidak seindah yang dilihat. Realitinya sebuah istana usang, kemahiran senibina yang diaplikasikan adunan batu marmar dari Italy, adalah kejayaan arkitek dari Scotland ini membuahkan impian Kellie Smith, tetapi sayangnya ia berakhir dengan sebuah kematian yang sepi! Apakah pengunjung masih ingin berkongsi kisah duka damba cinta seperti LailaMajnun, Shah Jahan dan Mumtaz, Romeo dan Juliet? 
Kellie's Castle, sebuah istana lama dibangunkan sebagai lambang cinta Smith kepada isterinya, Agnes. Istana zaman kolonial dibina antara 1909-1926, seorang hartawan Scotland, Wiliam Kellie Smith dilahirkan di sebuah kampung bernama Kellas, Dallas, Scotland pada 1/3/1870, di bahagian timur laut telah berhijrah ke Malaya 1890, ketika berumur 20 tahun untuk mencuba nasib. Semasa beliau di Pulau Pinang, beliau berkenalan dengan Alma Baker, seorang kontraktor di Kinta. Perkenalan itu menjadikan Kellie Smith sebagai pengusaha ladang getah Kellas Estate, Kinta Kellas Estate, dan lombong bijih timah Kinta Kellas Dredging Company di Batu Gajah. Kellie adalah nama kepada ibunya. Pada 1905, Smith mendirikan kediamannya pertama, Kellas House. Pada 1909 batu asas istana kedua didirikan sebagai simbol keagungannya. Istana ini terletak di Kilometer 5.5 Jalan Simpang Pulai-Batu Gajah ini telah menghutangkan nyawa khidmat 70 orang pekerja yang kebanyakkannya dari Madras, India. Batu batu dan marmar yang digunakan adalah diimport dari Italy. Tetapi semasa pembinaanya satu tragedi menimpa dan mengorbankan ramai pekerja Smith. Mengikut kepercayaan kaum India, kuil harus dibina bagi mententeramkan tuhan mereka. Bangunan itu dibina mengikut rupabentuk sebuah istana di India. Tukang-tukang Madras yang membangunkan istana itu mempunyai 24 bilik, sebuah cellar dan terowong rahsia, dilengkapkan dengan lift iaitu yang pertama di Tanah Melayu. Di tingkat kedua, akan dibina sebuah padang tenis berlantaikan simen. Berita mengenai bangunan itu pernah disiarkan dalam akhbar London Financier pada 15 September 1911. Akhbar itu menyifatkan rumah ketua pengurus Ladang Kellas itu paling unik di seluruh Timur Jauh, senibina segi bentuk dan keluasan istana yang besar. Apabila Perang Dunia 1, tamat, sejenis wabak Spanish Flu merebak dari Eropah ke Asia, hinggalah ke Tanah Melayu. Ramai pekerja ladang dijangkiti wabak meninggal dunia. Ketua pekerja meminta Kellie Smith membina sebuah kuil supaya mereka boleh mendoakan keselamatan pekerja dari wabak tersebut. Kellie Smith fasih bertutur bahasa Tamil dan Melayu. Beliau mengarahkan semua tukang membina sebuah kuil baru di kawasan ladang berhampiran dengan jalan raya. Di bumbung kuil itu terdapat sebaris patung dewa Hindu, di tengah-tengah barisan tersebut terdapat sebuah patung dengan pakaian pengurus ladang berbangsa Eropah bertopi putih. Kuil tersebut masih digunakan oleh pekerja Ladang Kinta Kellas hingga ke hari ini.Kami tiba di tangga batu usang yang dibina pada tahun 1915. Istana ini dikatakan berhantu kerana ramai yang pernah ternampak hantu orang putih di dalamnya. "Tak nak naik! Mama! Ariq, takut!" jerit anak kecilku. Alamak!mana Papa ni!. "Paaaaaa, adik tak nak naik!" jeritku memecahkan keheningan ditangga usang. Papa yang berada 20 langkah dari kami, kembali ke bawah, mendukung si kecil ini..."Mana ada ape-ape leeee, tak yah takut!" Sambil itu sempatlah posing sikit artis-artis kecil ini. Aku masih terfikir akan cerita yang sudah ku baca dari blog-blog peminat misteri istana ini. Ah! apa yang pasti, istana Kellie Smith ini, kesuramannya bila dihayati dan ditenungi, perasaan aneh akan menyelubungi. Masih ada lagi tiang asal istana bewarna biru bersemadi. "Eh, ada telaga, lah!" suara Nurin memecah lamunanku seketika. Aku bergegas dan menghampiri telaga usang itu. Sudah berkarat tetapi itulah telaga menuju ke terowong bawah tanah, mempunyai bilik2 tetapi telah ditutup - dilarang masuk. Adapun sel menyimpan wain atau arak. Habis kesemua bilik2, tangga kecil kami bongkar, lawati, tempat sembahyang pun, klick! klick....
Tingkat 2, mata kami tertumpu pada kertas A4size berlaminate. Koridor panjang itu adalah laluan roh Sir William Kellie Smith berkeliaran. Hish! seram gak... oleh kerana hari masih siang, tak le takut! Di salah sebuah bilik, aku terjumpa lagi kertas A4size berlaminate. tak pula ku ketahui. Tiada perasaan takut atau seram cuma keletihan. Dah tawaf semua tempat malangnya tingkat bawah tanah tidak dibenarkan masuk. Mungkin dikhuatiri ada haiwan berbisa atau retakan tanah merah dan semak rumput yang menggila!. Adapun terowong yang mempunyai bilik bawah tanah itu menghubungkan antara ladang Kellie ke seberang sungai. Didapati ada sebuah jambatan besi usang yang masih tersergam di belakang pokok tua berusia 105 tahun itu dan bilik pengawal serta tempat kuda. 30 tapak langkah belakang istana ini, rumah quarters dua deret adalah sebuah Kem Latihan telah ditutup, suatu masa dahulu dijadikan tempat latihan jatidiri oleh badan tertentu. Tidak diketahui kenapa ia ditutup. Adakah mereka yang pernah hadir mengikuti kem bina diri di situ dan bermalam di situ telah dikacau... atau mereka telah nampak sesuatu yang agak menyeramkan...hanya mereka sahaja yang boleh menjawab persoalan kepada misteri ini....
Pembinaan yang bermula pada tahun 1915 ke atas istana besar inimempunyai seni bina lain dari yang lain. Pembinaan tidak dapat diteruskan kerana kematian mengejut. William meninggal di Lisbon, Portugal pada 11 Disember 1926, semasa berusia 56 tahun, Smith diserang penyakit Pneumonia. Kerja-kerja terhenti pada Disember 1926 setelah kematian Smith. Isteri beliau menjual segala hartanya di Malaya dan pulang ke England. Istana yang mempunyai 6 tingkat ini sempurna dengan sel menyimpan arak, tiang tiang kukuh dan arca moorish dan dinding yang bercirikan Greco Roman, ruang legar di tingkat atas untuk berparti dan juga shaft lift yang pertama di Malaya. Ada yang mengatakan dia ke sana ingin melihat lif yang ditempah sudah siap. Lif ini adalah yang pertama akan digunakan pada masa itu. Tetapi sekarang lif itu menjadi kediaman lalang hijau berkongsi dan haiwan-haiwan tak diundang!Bayaran masuk (Cuti Umum)
